Hi,

After what seems like an eternity looking for a job, I've finally landed something and plan on resigning shortly. I may resign 31 July 13 and notice period the month of August 13. I have a few questions for those in the know.

- Leave pay - I have 35 days and the contract says no more than 21 can be accrued - and the rest will be forfeited. I've heard this MAY only stand IF the employer has warned you over and over to take because you'll forfeit - and even then it's sketchy. Will I get 35 or 21?

- Commission - Considering my notice period include August - surely any work and commission accrued during August, should still be paid out to me? Even if this is paid end September, it's commission and work I've got myself?

- Would the above be effected *if* they asked me to leave straight away, as I'm going to a competitor? I understand they'll still need to pay August salary - but if they ask me to leave prematurely they won't need to pay commission as I haven't worked?

- Timing - will they pay me at the standard payroll time (end Aug) regardless of whether I work it out or not? Someone told me within a week I need to paid out my leave.
