Ripping to HDD and selling your CD collection - legal?

Lets discuss...

Yesterday I had a bit of a scuffle with a German audiophile... he copied his entire CD collection to HDD and CD-R and then proceeded to sell the original CDs on fleabay.

That is illegal no matter how you look at it - since he is generating money from the CDs.

What is your opinion?
